Guardianship

The judicial modification of a person's capacity can be focused on two essential institutions: guardianship and conservatorship.

Having both institutions vocation of service towards the minor person, with modified capacity or incapacity, the guardianship has as its object the total governance of the person and its assets by a third party, designated as the guardian, who can be a natural or legal person, and is appointed by the judge when the sentence determines the impossibility of the person under guardianship to govern himself, understanding the impossibility to manage his person and assets in an absolute way.

The guardianship, however, will result from a court decision that, far from absolutely incapacitating a person to manage his or her personal and financial affairs, establishes areas in which this capacity must be "completed" by a third party, called a guardian.
